1. General.
1.1. This document is a public offer (offer) of SE KO "Bus Station" - hereinafter Bus Station - a concluded contract, the subject of which is set forth below.
1.2. The Agreement is considered concluded and received due to the fact that the orders / Passenger actions provided for in the Rules, purchase and return of tickets />
1.3. Complete and unconditional acceptances are open (that is, the answer to all possible orders) is the commission by the customer. >
1.4. The Customer / Passenger agrees to the processing of his personal data, as well as to consent to the processing of personal data of other passengers, subject to reservation and purchase of tickets. The processing of personal data of the Customer / Passenger is carried out by the Car Station in order to fulfill this offer, the contract for the carriage of passengers, the requirements of the legislation of the Russian Federation, the provision of personal data of individuals - passengers and visitors of SE KO Bus Station.
2.Terms and definitions.
2.1. Bus station - SE KO "Avtovokzal", a legal entity that sells tickets for bus services of carriers and for this purpose collects, stores, accumulates, updates, blocks, deletes and transfers personal data.
2.2. The subjects of personal data (hereinafter referred to as SPD) are individuals: passengers and visitors of the SE “Bus Station.”
2.3. 3customer is a user of the site who has placed and paid for the order using the service of buying and selling tickets on the site www.avl39.ru.
2.4. Passenger - an individual transported by a vehicle on the basis of a passenger carriage agreement, buying a ticket for this carriage on the website www.avl39.ru.
2.5. Ticket - an entry in the accounting system of the Bus Station containing the identification data of the Customer / Passenger, as a Ticket in electronic form confirming the acceptance of this offer, the conclusion of a passenger carriage agreement.
3. Subject of the contract.
3.1. The bus station in real time provides the Customer / Passenger with access to the ticket purchase and return service on the website www.avtovokzal39.ru, and the Customer / Passenger uses the service and makes the purchase of Tickets personally or indirectly.
3.2. This public offer is considered accepted, and the contract is concluded (acceptance of the offer), from the moment the Customer / Passenger confirms their consent to its terms by selecting (ticking) “I’ve familiarized with the rules for buying and returning tickets, as well as with the offer”. 4. Procedure for payment and ticketing.
4.1. The bus station provides ticketing. Tickets are priced from the fare / combination of fares and charges set by the carrier.
4.2. The issued Ticket must be paid by the Customer within the time specified after issuing the Ticket (time limit) using a bank card.
4.3. After the Customer / Passenger has paid for the Ticket and credited the funds to the account of the Bus Station, the carriage agreement is deemed concluded.
4.4. If the Ticket is not paid before the time limit, it will be canceled. A canceled Ticket cannot be refunded for a re-payment.
4.5. The Customer / Passenger confirms that the personal data of all passengers entered by him when working on the website of the Bus Station, necessary for concluding a contract of carriage, are reliable and accurate. Providing inaccurate personal data will invalidate the ticket.
4.6. The obligations of the Bus Station are deemed to have been fulfilled properly and in full from the moment the Customer / Passenger sends the Ticket containing the conditions of the contract of carriage concluded by the Customer / Passenger to the email address indicated by the Customer / Passenger.
4.7. The bus station has the right to refuse to issue to the Customer / Passenger the electronic transportation document or additionally require a copy of the bank card holder’s documents if the bus station has reason to believe that the transaction to pay for the Order with a credit card may be considered fraudulent.
4.8. The conditions for returning, amending the issued electronic transportation documents and other conditions for the provision of transportation services are regulated by the Rules for the carriage of passengers and baggage, the contract of carriage, this public offer, the Charter of motor transport of the Russian Federation and other legislative acts of the Russian Federation, and may impose penalties on the Customer / Passenger .
4.9. Refunds for unused transportation are carried out in accordance with the return procedure posted on the website of the Bus Station in the section “Rules for the purchase and return of tickets.”
4.10. In case of returning tickets paid with a credit card, funds will be returned to the card used for payment. Cash withdrawal and transfer to other details is not possible.
5. Other conditions.
5.1. In accordance with Part 5 of Article 6 of the Federal Law of July 27, 2006 No. 152-ФЗ “On Personal Data”, the processing of personal data of the Customer / Passenger is carried out in order to fulfill this offer and the contract of carriage, of which the Customer / Passenger is one of the parties. The Customer / Passenger agrees (confirms the consent of all passengers included in the reservation) to the processing of personal data entered during booking (surname, name, gender, date of birth, citizenship, series and passport number, phone number, email address) including on their transfer to third parties providing or servicing the transportation, and cross-border transfer of the specified personal data.
5.2. The bus station is obliged to use the personal data of the Customer / Passenger specified by the Customer / Passenger when placing the Order, exclusively for processing sales, identifying the Customer / Passenger and fulfilling obligations under this public offer. The bus station is obligated not to store or use the personal data of the Customer / Passenger to send documents and messages that are not related to the issued Tickets.
5.3. Customer / Passenger acknowledges and warrants that he is familiar with and agrees:
with the conditions for applying carrier tariffs, including the conditions for returning and exchanging tickets;
with requirements for foreign passports and other formal documents, including the remaining validity of a foreign passport required to obtain a visa and entry into the host country;
about the features and rules of customs, border, phytosanitary, veterinary control of the Russian Federation and foreign states, the obligation to comply with these rules;
with the rules for the carriage of passengers and baggage;
that passengers independently bear full responsibility for the validity of foreign passports, consent for the departure of minor children and other documents necessary for crossing the border.
6. Responsibility of the parties.
6.1. The parties are liable for failure to fulfill and / or improper performance of their obligations under this public offer in the manner and on the terms determined by this public offer and the current legislation of the Russian Federation.
6.2. The bus station is not responsible for the inability of the Customer / Passenger to issue an electronic transportation document for reasons of communication lines malfunction, customer / Passenger equipment malfunction, etc.
6.3. In case of force majeure circumstances (force majeure), including: epidemic, fire, volcanic eruption, flood, earthquake, other natural disasters and cataclysms, technological disasters, lack of electricity and / or computer network malfunctions, strikes, civil unrest, unrest , actions of state and other bodies, any other circumstances that impede the fulfillment of the Agency’s obligations under this public offer, the Bus Station is exempt from liability for partial or full failure ying its obligations.
6.4. The bus station is not responsible for possible violations and actions that are not within its purview, namely:
- for the provision by the Customer / Passenger of inaccurate, insufficient, untimely information and documents, violation by the Customer / Passenger of the terms of this public offer or requirements for documents;
for actions of consulates of foreign states, including for delay, refusal to issue a visa;
- for the actions of carriers, including (but not limited to) non-compliance by carriers with booking conditions and fare rules, conditions of a contract of carriage, change, cancellation, transfer, delay of flights (trains), failure to provide connections during transfer transportation, loss of baggage or personal belongings passenger.
In these cases, carriers to the Customer / Passenger are liable in accordance with Russian and international laws;
- for the actions of the immigration, customs, veterinary and phiosanitary authorities;
- for the actions (inaction) of passengers, namely: violation by a passenger of customs and border formalities, rules of travel and baggage, rules of conduct in the country of temporary residence; the passenger does not have travel documents issued by the Bus Station; no-show or delay of passengers to the place of departure of the bus;
- the absence of properly issued foreign passports and relevant documents for the export of children from passengers.
6.5. The Customer / Passenger assumes full responsibility for the preparation of all necessary documents for the trip. The Customer / Passenger should familiarize themselves with and fulfill all the requirements of the country to which they are sent, regarding the processing of documents required upon departure and arrival, as well as for transfer transportation to follow the entire route, the need and conditions for issuing visas, valid passports, powers of attorney or other documents for traveling children, etc.
The bus station is not responsible for ignorance or non-compliance by the Customer / Passenger with the specified requirements.
6.6. The parties will seek to resolve disputes and disagreements that may arise during the execution of this public offer through negotiations, including in compliance with the claims procedure. The bus station considers the claim of the Customer / Passenger, sent in writing to the mailing address of the Agency, within 10 (ten) business days from the date of receipt by the bus station. If the consideration of the claim requires clarification from the carriers, the period of response to the claim may be extended until a response is received from the carrier. If it is not possible to resolve the dispute through negotiations, including in a claim procedure, the dispute shall be considered by the appropriate court at the location of the defendant.
